Mumbai Youth Abdulla Shamsulla Mansuri Granted Bail in Mobile Theft Case

Mumbai, Maharashtra – May 4, 2022 – Abdulla Shamsulla Mansuri, a 20-year-old service worker, has been granted bail by the Sessions Court for Greater Mumbai in connection with a mobile theft case. Additional Sessions Judge B.V. Wagh (C.R. No. 24) granted the bail in Bail Application No. 940 of 2022, related to C.R. No. 133/2022 registered at Antop Hill Police Station.

Mansuri was arrested and charged under Sections 392 (robbery), 504 (intentional insult with intent to provoke breach of the peace), read with Section 34 (acts done by several persons in furtherance of common intention) of the Indian Penal Code.1

Case Background:

The prosecution alleged that on April 8, 2022, around 10:00 a.m., the complainant was driving a tempo from Antop Hill to Dadar. At the Sion Koliwada bridge, a motorcycle rider allegedly waylaid him and hurled abuses. Mansuri, who was riding pillion, allegedly stole the complainant’s mobile phone and attempted to flee. However, police intervention led to the immediate apprehension of both individuals, and the stolen mobile phone was recovered.

Arguments and Court’s Reasoning:

The court, after hearing arguments from both sides and reviewing the application and police report, noted that Mansuri was apprehended red-handed, and the stolen mobile phone was recovered from him. The court also observed that Mansuri had been in custody since April 8, 2022, and had no prior criminal record. Additionally, the investigation was deemed to have progressed significantly.

“On going through the investigation papers, it appears that the applicant is nabbed red handed. The stolen mobile is recovered from the applicant. Since 8.04.2022 the applicant is behind bar. No criminal antecedent has been demonstrated against the applicant. The investigation is considerably progressed and further incarceration of applicant is unwarranted,” Judge Wagh stated.

Considering the nature of the accusation and the progress of the investigation, the court deemed Mansuri’s further detention unnecessary and granted him bail, subject to stringent conditions.

Bail Conditions:

Judge Wagh granted bail to Abdulla Shamsulla Mansuri on the following conditions:

  • Execution of a personal bond of ₹15,000 with a surety of the same amount.
  • Submission of residential address proof and contact numbers to the Investigating Officer.
  • Attendance at Antop Hill Police Station every Monday between 11:00 a.m. and 2:00 p.m. until the filing of the chargesheet.
  • An undertaking not to directly or indirectly induce, threaten, or promise any person acquainted with the case.
  • A restriction on leaving India without prior court permission.
  • Bail to be processed before the lower court.
