Mumbai, January 31, 2017 – The Special Court for CBI at Greater Bombay, presided over by Special Judge N. K. More, today granted bail to Shri. Dilip Tulsiram Khaire, a 45-year-old public servant, who was arrested in connection with a bribery case registered by the CBI’s Anti-Corruption Bureau (ACB), Mumbai.
The bail application, numbered 69 of 2017 and arising from Remand Application No. 110 of 2017 in RC BA1/2016/A0035-MUMBAI, was heard today. Advocate Mr. Sandeep D. Kadam appeared for the applicant, while Advocate Mr. Sony represented the Respondent/CBI.
Mr. Kadam argued for bail, emphasizing that Khaire is a permanent resident of Mumbai with no prior criminal record. He further submitted that as a public servant, there was no possibility of him tampering with prosecution witnesses.
Conversely, the learned Public Prosecutor (PP) representing the CBI argued that the investigation was still in progress, and releasing the applicant on bail could lead to him tampering with prosecution witnesses and evidence.
After considering the submissions from both sides and reviewing the grounds mentioned in the application, Special Judge N. K. More ruled in favor of granting bail. The court reasoned that since the applicant is a permanent resident of Mumbai and a public servant, there was no significant risk of him fleeing. The court also noted that conditions could be imposed on the applicant to ensure he does not tamper with prosecution witnesses or evidence.
Consequently, the court passed the following order:
- Bail Application No. 69 of 2017 is allowed.
- Accused Dilip Tulsiram Khaire shall be released on furnishing a Personal Recognizance (P.R.) bond of ₹25,000/- (Rupees Twenty Five Thousand only) with one or two sureties in the like amount.
- The accused shall not tamper with the prosecution witnesses or evidence.
- The accused shall attend before the Investigating Officer in the office of C.B.I., Mumbai, every Monday between 11:00 am and 1:00 pm until further orders.
- The accused is permitted to deposit cash of ₹25,000/- in the Court in lieu of surety for a period of one month. The cash amount shall be accepted after treasury hours.
Bail Application No. 69 of 2017 stands disposed of.
