2 UPON hearing the counsel the Court made the following
O R D E R
The present Special Leave Petitions have been filed seeking post-arrest bail, which came to be declined by the High Court by common impugned order dated 03.12.2021.
Notice was issued by this Court in the instant petitions on 28.11.2022 and 16.12.2022. It is informed that after investigation, chargesheet has been filed and the other Directors, who are also co-accused in the instant FIRs [being FIR Nos. 343/2017, 139/2017, 32/2018 and 507/2018 in SLP (Crl.) No. 11738 11741 of 2022 ] and [ FIR Nos. 343/2017, 139/2017, 32/2018, 95/2018 and 507/2018 in SLP (Crl.) Nos. 12724-28 of 2022 ] have already been granted post-arrest bail by this Court. Few of the orders have been placed on record.
It can also be noticed that the petitioner Ramdas [in SLP (Crl.) No. 11738 11741 of 2022] is 74 years of age and the petitioner Namdev Vittal Kale [in SLP (Crl.) Nos. 12724-28 of 2022] is 66 years of age, and they are in judicial custody since 26.06.2018 and 14.06.2018 respectively.
After hearing learned counsel for the parties and taking into consideration the material on record and without expressing any opinion on merits/demerits of the case, both the petitioners have made out a case of post-arrest bail. Ordered accordingly.
The petitioners shall be produced before the concerned trial court within a period of three days and be released on bail on such terms and conditions to the satisfaction of the trial court concerned.
