UPON hearing the counsel the Court made the following
O R D E R
Heard the learned senior counsel for the petitioner as also the learned counsel for the respondent-State of Gujarat and perused the petition papers.
2 Though, we note that the petitioner has been in custody for more than five years, keeping in view the nature of the incident for which the petitioner has been tried and further since it is brought to our notice that the trial is under progress and 18 witnesses out of 48 witnesses have been examined, at this stage, we see no reason to interfere with the impugned order. However, we expect the trial to be concluded expeditiously. In any event, if the trial does not conclude within a period of one year from this day, liberty is reserved to the petitioner to file appropriate application seeking bail before the Trial Court, whereupon the Trial Court shall consider the same in accordance with law.
Petition is accordingly disposed of.
Pending application(s), if any, shall stand disposed of.
