UPON hearing the counsel the Court made the following
O R D E R
1. Heard learned counsel for the petitioner as also learned Dy. Advocate General appearing on behalf of the respondent State and carefully perused the material placed on record.
2. The petitioner seeks enlargement on regular bail in Case FIR No.331 dated 29.06.2020, lodged under Sections 148, 149, 323, 324 and 506 IPC (Sections 325 and 307 IPC and provisions of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act, 1989 added later on), registered at Police Station Shahabad,
District Kurukshetra.
3. The petitioner is the main accused to whom the head injury with iron rod is attributed. The petitioner was arrested on 11.08.2020 and he is in custody since then. Most of the crucial witnesses including the injured victim has been examined. It is true that the petitioner has criminal antecedents but he cannot be 2 kept in custody indefinitely as the conclusion of trial is likely to take some time.
4. In this view of the matter but without expressing any views on the merits of the case, the petitioner is directed to be released on bail subject to his furnishing bail bonds to the satisfaction of the Trial Court.
5. Keeping in view the past conduct of the petitioner, it is directed that in case he is found involved in some other criminal case, that will be treated as a sufficient ground for cancellation of bail granted to him today by this Court, and such an incident shall immediately be brought to the notice of this Court by the respondent State.
6. The Special Leave Petition stands disposed in the above terms.
