The status report as directed by this court in the order passed on 07.12.2022 has not yet been filed. The admitted position is that the appellant has been granted interim protection by this court on 16.03.2022. At this stage, there is no allegation that he is not cooperating with the investigating agency.
Learned counsel for the appellant submits that on 30.12.2022 itself, he was questioned by the investigating agency. In this background, we do not think it is necessary to detain the appellant pending trial.
We, accordingly, set aside the impugned order and direct that in the event the appellant is arrested in connection with FIR No.148/2021 dated 09.04.2021 registered with Zirakpur Police Station, District SAS Nagar, the appellant shall be released on bail on such terms and condition the concerned Trial Court may consider fit and proper.
This order is being passed on condition that the appellant shall co-operate with the investigating agency.
The appeal is allowed in the above terms.
