Heard Ms. Kamini Jaiswal, learned counsel appearing for the applicant and Mr. Nikhil Goel, learned Additional Advocate General appearing for the State.

The instant applications have been filed by the applicant – Mohammed Farooq Ali @ Farooq in the form of three separate additional affidavits in connection with Criminal Appeal No. 502 of 2020, Criminal Appeal Nos. 500-501 of 2020 and Criminal Appeal Nos. 498-499 of 2020. In the affidavits, it has been pleaded that the daughter of the applicant is getting married on 14.01.2023. He wants to be released on interim bail for this reason. The plea for bail of the applicant has been strongly opposed by Mr. Nikhil Goel, learned Additional Advocate General, but considering the reason for which the applicant wants bail, in our opinion, as a temporary measure, he ought to be released on custody parole.
Thus, we direct the State that the applicant Mohammed Farooq Ali @ Farooq be released on custody parole forthwith to attend the marriage of his daughter and consequential ceremonies for a period of four days. Thereafter, he shall be taken back in custody in the correctional home. The plea for bail of the applicant will be considered at a later stage.
List the appeals along with applications for bail in the first
week of March, 2023.
