MD. JAVED VERSUS THE STATE OF JHARKHAND & ANR. Special Leave to Appeal (Crl.) No.544/2022

1 IN THE SUPREME COURT OF INDIA CRIMINAL APPELLATE JURISDICTIO CRIMINAL APPEAL NO.273/2023 [@ SLP [CRL.] NO. 544/2022]
MD. JAVED Appellant(s)
VERSUS
THE STATE OF JHARKHAND & ANR. Respondent(s)
O R D E R
Leave granted.
Counter affidavit filed by the State is taken on record. Having heard learned counsel for parties we have great reservation on the nature of the conditions being provided for grant of bail in the initial order itself dated 3/2-04-2019 seeking to govern how the two parties should lead their personal life while considering the aspect of bail. Naturally, this has not worked out. On that basis, the bail is sought to be cancelled by the impugned order.
We believe that this is not a case forcancellation of bail as the original conditions provided itself are quite unworkable.
2 The appeal is allowed leaving the parties to bear their own costs.……J.
