UPON hearing the counsel the Court made the following
O R D E R
IA No 115187/2022 In SLP (Crl) No 2456/2020
1 The petitioner has been convicted by the Sessions Judge, Godda on 23 April 2005 in Sessions Trial No 131 of 2004 of an offence punishable under Section 376 of the Indian Penal Code and sentenced to suffer rigorous imprisonment for seven years. The High Court has confirmed the conviction by an order dated 2 January 2019.
2 The petitioner has undergone four years imprisonment out of the total sentence.
3 Hence, at this stage we are of the view that the petitioner should be directed to be released on bail subject to such terms and conditions as may be imposed by the Sessions Court in connection with Sessions Trial No 131 of 2004.
4 The Interlocutory Application for grant of bail is disposed of.
