UPON hearing the counsel the Court made the following
O R D E R
Petitioner is aggrieved by the denial of bail to him; he is accused of committing offences under Sections 294, 325, 323, 326, 506, 34 IPC and Section 25 of the Arms Act. He has been in custody for over a year. Investigations in this case have been completed and the trial has commenced. The record would prima facie indicates that the incident involved a free fight resulting injuries to both side.
Having regard to the circumstances that the trial has commenced and taking into consideration that the petitioner has suffered incarceration for over a year, this is a fit case for grant of regular bail. It is directed to enlarge the petitioner on bail on such terms and conditions as may be imposed by the Trial Court.
The impugned order is set aside; the special leave petition is disposed of.
All pending applications stand disposed of.
