UPON hearing the counsel the Court made the following
O R D E R
It is most unfortunate that only the direction for the personal presence of the Principal Secretary has resulted in finally the Public Prosecutor to be appointed possibly within a day of the order being issued.
We have put to learned Principal Secretary that the credibility of the State Department to carry out the prosecution has been put in doubt by their own conduct. He assures the Court that all steps would be taken for day to day trial as far as possible. We would like to see this translate into action and thus, consider appropriate to defer consideration in this matter till the next date.
Learned counsel for the complainant pointed out that on three occasions time schedule was fixed bu the said time schedule was de-railed because one or the other of the accused was not present. We thus, direct that all accused shall remain present on all dates otherwise we will be constrained to cancel the bail of those accused and the said accused be put to notice of this fact.
