UPON hearing the counsel the court made the following
O R D E R
We have heard learned counsel for the parties.
Considering the fact that the trial is still 2 at a nascent stage inasmuch as only 2 out of 22 prosecution witnesses have been examined and the conclusion of the trial is likely to take unaccounted time and the petitioner has already undergone 5 years and 8 months of incarceration, we are of the considered opinion that he is entitled to be released on bail. Accordingly, we direct the petitioner to be released on bail subject to such terms and conditions as the trial Court may deem fit and proper to impose.
The special leave petition stands disposed of. Pending application(s), if any, shall stand disposed of.
