UPON hearing the counsel the Court made the following
O R D E R
1. Heard learned counsel for the parties and carefully perused the material placed on record.
2. Delay condoned.
3. The petitioner seeks his enlargement on bail in C.R. No.133/2017, dated 21.10.2017, under Sections 143, 147, 148, 149, 201, 302 IPC, registered at Sanjay Nagar Police Station, Sangli.
4. It appears that some scuffle took place during cremation ceremony between two groups which led to multiple knife injuries to 2
Sarfraz Irani on his back. He was taken to hospital but passed away during treatment. The family of the petitioner was named as the accused persons and his father was also arrested but has since been enlarged on regular bail. There are allegations that the petitioner absconded for nine months and could be apprehended on 14.08.2018. The petitioner is in custody since then i.e. for the last about four and a half years. The chargesheet has been filed but the charges are yet to be framed. Thus, conclusion of trial will take some time.
5. Taking into consideration the period already spent by the petitioner in custody but without expressing any views on the merits of the case, the petitioner is directed to be released on bail subject to his furnishing bail bonds to the satisfaction of the Trial Court.
6. Since the petitioner has been earlier absconding, the Trial Court will impose such conditions so as to ensure that he does not absent from any date of hearing in the Trial Court and his passport etc. also be deposited before the Trial Court.
7. The Special Leave Petition stands disposed of accordingly.
8. As a result, pending interlocutory applications also
stand disposed of.
