UPON hearing the counsel the Court made the following
O R D E R
Heard the learned senior counsel for the petitioner as also the learned counsel for the respondent-State of Maharashtra and perused the petition papers.

2 In the background where the co-accused have been released on bail, we note that the petitioner has already spent about 04 years 07 months in custody. The trial is yet to commence. In that light, we deem it appropriate to accept the prayer made in the petition seeking grant of regular bail to the petitioner.
Accordingly, the petitioner is directed to be released on bail subject to the conditions to be imposed by the Trial Court. In addition to the usual conditions to be imposed by the Trial Court,
we make it clear that a condition, also to the effect that the petitioner on being released, shall not go back to the Thane District, Maharashtra, except for the purpose of attending court proceedings during trial, shall be imposed by the learned Sessions Judge. After the material witnesses are examined, if any application for modification of the said condition to go to Thane District is made on behalf of the petitioner, the learned Sessions Judge may consider the modification of such condition depending on the facts and circumstances existing then. Petition is accordingly, disposed of.
Pending application(s), if any, shall stand disposed of.
