Mr. Tilak Raj Pasi, Adv.
Mr. Neeleshwar Pavani, Adv.

For Respondent(s)
UPON hearing the counsel the Court made the following
O R D E R
We note that though notice was ordered to the respondent and it has been served, there is no representation on behalf of the respondent. In any event, the petition would require detailed consideration on the respondent being represented. For the present, learned senior counsel appearing for the petitioner has put forth her contention with regard to the interim bail sought in the petition.
1 SLP (Crl.) No.5484/2019
Having heard learned senior counsel for the petitioner, we note that as per the certificate of imprisonment, the petitioner has undergone about 12 years of custody. Since the petition is to be heard after the respondent put in their appearance and the matter would take some time, we are of the opinion that the petitioner be released on bail subject to the petitioner not being required to be detained in any other case. We direct that the petitioner be released on bail subject to the conditions to be imposed by the trial court. The learned counsel for the petitioner may intimate the learned Standing Counsel for the respondent State about the pendency of the special leave petition.
Records be called for.
