UPON hearing the counsel the Court made the following
O R D E R
Heard Mr. Rishi Malhotra, learned counsel appearing for the petitioner. The State of Gujarat is represented by Ms. Swati Ghildiyal, learned counsel.
2. The submission made by the rival counsel is considered together with the counter affidavit filed by the State. This indicates multiple criminal antecedents of the petitioner who is incarcerated since long in prison. Some of the incidents are of the time when he was inside the jail.
3. In the circumstances, we are of the view that the State is right in rejecting the premature release of the petitioner at this stage, under its order dated 02.03.2022.
3. The Writ Petition is accordingly dismissed. Pending application(s), if any, stand closed.
