UPON hearing the counsel the Court made the following
O R D E R
1. Heard learned counsel for the petitioner and carefully perused the material placed on record.
2. The prayer in this petition is to release the petitioner on regular bail in FIR No.366 of 2019, registered at Police Station
Entally, District ESD/Kolkata, West Bengal under Sections 20(b)(ii) (c) and 29 of the NDPS Act.
3. The allegation is that commercial quantity of 1 Kg. 100 gms of charas and 21 kg. 800 gms of ganja were recovered from the 2 joint possession of the petitioner and her husband from their residence. The other family members have also been implicated. The petitioner was arrested on 28.11.2019 and she is, thus, in custody for more than three years. The trial is at its preliminary stage and the prosecution evidence has yet to start. There are no criminal antecedents of the petitioner.
4. Taking into consideration all the attending circumstances and especially the period already undergone by the petitioner in custody but without expressing any opinion on the merits of the case, the petitioner is ordered to be released on bail subject to her furnishing bail bonds to the satisfaction of the Trial Court.
5. The Special Leave Petition stands disposed of accordingly.
