Leave granted.
Heard the learned counsel appearing for the parties.
Taking into consideration the fact that the appellant is under incarceration for more than 5 years, there is also a cross-case and the co-accused has been granted bail and the trial is also not proceeding despite the time granted by the High court, we are inclined to grant bail to the appellant.
In such view of the matter, we set aside the impugned order passed by the High Court and t he appellant is, accordingly, directed to be released on bail on such terms and conditions as deemed fit and proper by the Trial Court.
The appeal is, accordingly, allowed.
Pending application(s), if any, shall stand disposed of.
