UPON hearing the counsel the Court made the following
O R D E R
This Court while issuing notice on 20.11.2023 had granted interim protection against arrest of the petitioner.
We heard the learned counsel for the State. He has vehemently opposed the grant of anticipatory bail to the petitioner/accused. Having considered the matter in detail we
confirm the order dated 20.11.2023. We also take note of the fact that the petitioners husband has already been granted regular bail.
We direct that the petitioner must be granted the benefit of anticipatory bail. In the event the petitioner is arrested, he shall be released on bail on such conditions as the Trial Court may impose.
Needless to mention that the petitioner shall diligently appear before the Trial Court whenever the matter is listed and further co-operate with the investigation/ trial failing which the prosecution can seek cancellation of bail. The special leave petition is disposed of.
Pending application(s) shall also stand disposed of.
