Heard learned counsel appearing for the appellant and the
State.
We have gone through the materials disclosed and having regard to the nature of the allegations against the appellant, we do not think this is a case where custodial interrogation of the appellant would be necessary. There are no other aggravating circumstances either justifying pre-trial detention of the appellant.
In such circumstances, we set aside the impugned judgment and order and direct that in the event of arrest of the appellant in connection with FIR being C.R.No.11191047230040 of 2023 dated 01.09.2023 registered with East Mahila Police Station, Ahmedabad, Gujarat, he shall be released on bail on such terms and conditions the concerned Court may consider fit and proper.

The appeal stands allowed in the above terms.
