Leave granted.
Heard learned senior counsel for the appellant and the State. We have gone through the records forming part of this proceeding along with the postmortem report as also a report dated 11.04.2022, captioned State Medico Legal Report. At this stage, what we find from the content of the said report is that the cause of death could not be ascertained In such circumstances, we do not think continued detention of the appellant is necessary. Trial has already commenced. We are apprised by learned senior counsel for the appellant that four witnesses have already been examined.
We, accordingly, set aside the impugned order and direct that the appellant be released on bail in connection with FIR No.1457/2021 registered with Police Station Kavinagar, District
Ghaziabad, Uttar Pradesh, on such terms the Trial Court may consider fit and proper. The appellant, however, shall not delay the trial in any manner whatsoever and participate in the trial.
The appeal stands allowed in the above terms.
