UPON hearing the counsel the Court made the following
O R D E R
Heard Mr. Ashwani Kumar Dubey, learned counsel appearing for the petitioner.
2. The counsel points out that the later FIR No.188/2021 was filed against the petitioner and 16 others following the FIR NO.187/2021 lodged earlier at 15:30 hours, for the incident which occurred on 30.11.2021. The order passed by this Court on 02.01.2024 (Annexure P-12) is read out by the counsel to show that this Court had noted that the petitioner Dinesh Singh is not involved with the firing and the High Court had mistakenly granted bail to the co-accused (Satish Kumar), who actually had the lead role in the crime.
3. Issue notice, returnable in three weeks.
4. The petitioner is permitted to serve Dasti notice additionally, to the Standing Counsel for the State.
5. In the meantime, if the Police wish to arrest the petitioner (Dinesh Singh @ Dinesh Kumar Singh) in connection with the case arising out of FIR No.188/2021, upon furnishing bail bond of Rs. 20,000/-, to the satisfaction of the Arresting Officer, he shall be released on bail.
6. The petitioner is permitted to file additional document within two weeks.
