Leave granted.
Heard learned counsel appearing for the appellant and the
respondent-State.
In response to our query, learned counsel for the State has apprised us that the appellant has joined the investigation. FIR was registered in this case on 14.04.2023.
In such circumstances, we do not think custodial interrogation of the appellant is necessary. There is no other aggravating factor against the appellant that would justify his pre-trial detention.
We, accordingly, set aside the impugned judgment and order and direct that in the event of arrest of the appellant in connection with FIR bearing C.R.No.11198068230274 of 2023 dated 14.04.2023 registered with Bharatnagar Police Station, District Bhavnagar, Gujarat, he shall be released on bail on such terms and conditions the Trial Court may consider fit and proper.
We, however, add here that conditions for the appellant being enlarged on bail would be that the appellant shall cooperate with the investigating agency and he shall report to the investigating officer whenever required to do so. He shall also not go out of the State of Gujarat without obtaining leave from the Trial Court.
The appeal stands allowed in the above terms.
