O R D E R
1. The appellant who was charged and convicted for the offence punishable under Section 307 of the Indian Penal Code, 1860 (for short, the IPC) seeks to overturn the same.
2. Taking note of the fact that there are eye-witnesses whose testimonies were taken note of by both the Courts below, we are not inclined to interfere with the conviction. However, the occurrence took place in the year 1980. The allegation against the appellant is that in a scuffle, the appellant attacked the victim and stabbed him with a
knife. The occurrence had happened nearly 44 years ago. Now, the appellant is at an advanced age. Even the High Court though wrongly noted the sentence, took into
circumstances the mitigating factors.

3. In such view of the matter, we are inclined to modify the sentence to the one already undergone.
4. Accordingly, the appeal is allowed in part. Bail bonds, if any, shall stand discharged.
5. Pending application(s), if any, shall stand disposed of.
