UPON hearing the counsel the Court made the following
O R D E R
Heard Mr. Parinav Gupta, learned counsel appearing for the
petitioners. The counsel would refer to this Courts order dated 13.10.2023 where notice was issued and also the later order passed on 01.12.2023 allowing Dasti service on States counsel.
2. Notwithstanding the above, the counsel for the State of Madhya Pradesh is not present in the Court.
3. As the Criminal Appeal No.4086 of 2022 filed by the petitioners are pending and they have already been incarcerated for about 2 years and the maximum sentence is 5 years for their conviction under Section 471 of the IPC, we deem it appropriate to order for suspension of sentence for the petitioners pending their criminal appeal. It is ordered accordingly.

4. The petitioners (Dilip Singh Chouhan, Ratan Singh Parmar and Shivnandan Chouhan) be released on bail forthwith on such terms and conditions as may be imposed by the trial court.
5. With the above order, the Special Leave Petition stand disposed of.
6. Pending application(s), if any, stand closed.
