Heard the learned counsel appearing for the parties.
Considering the evidence of the official prosecution witnesses, who have not supported the prosecution and the manner in which sample was collected, this is a case where the appellant deserves to be enlarged on bail.
Accordingly, the appeal is allowed.
The appellant shall be produced before the Special Court within a period of one week from today. The Special Court shall enlarge the appellant on bail on appropriate terms and conditions till the disposal of the trial.
