UPON hearing the counsel the Court made the following
O R D E R
Heard Mr. Jasbir Singh Malik, learned counsel appearing for the petitioner.
2. The counsel would submit that the petitioner is an elected Sarpanch and her role cannot be distinguished with the other three co-accused who were granted anticipatory bail by the High Court respectively on 15.06.2023, 19.06.2023 and 05.07.2023. Yet the similar prayer for pre-arrest bail was not entertained for the petitioner.
3. As can be noticed, the petitioner in order to contest the election, was required to be a Class 8 th pass and the allegation against her is that the educational qualification certificate was forged, to contest the election.
4. Considering the nature of the allegation against the petitioner, we are not inclined to grant the benefit of pre-arrest bail to the petitioner.
5. At this stage, Mr. Malik, learned counsel submits that the petitioner would surrender and then apply for regular bail. 6. Noting the above submission of the petitioners counsel, the petitioner is granted three weeks time to surrender. If the petitioner surrenders within three weeks from today and applies for regular bail, the concerned Court should consider the same expeditiously and on merits.
7. With the above order, the Special Leave Petition stands disposed of. Pending application(s), if any, stand closed.
