UPON hearing the counsel the Court made the following
O R D E R
Heard Mr. Vivek Gupta, learned counsel appearing for the petitioner. Also heard Mr. Anjuman Tripathi, learned Counsel appearing for the respondent State of Odisha.
2. The State counsel refers to the allegation in the FIR to argue that the bail is unmerited in the present case.
3. On the other hand, it is seen that the FIR was lodged by the petitioners sibling and the tussle is for possession of the ancestral property. The petitioner is in custody for about 7 months since he was arrested on 08.08.2023.
4. Considering the circumstances in this case, we deem it appropriate to grant bail. Accordingly the petitioner (Ch. Rajesh Kumar Subudhi) be released on bail in connection with the case arising out of FIR No.212/2023 registered at PS Gosaninuagaon, District Berhampur. Appropriate bail condition be imposed by the learned Trial Court.
5. With the above order, the Special Leave Petition is disposed
of. Pending application(s), if any, stand closed.
