CENTRAL BUREAU OF INVESTIGATION VERSUS AWDHESH KUMAR SINGH

1
IN THE SUPREME COURT OF INDIA
CRIMINAL APPELLATE JURISDICTION
CRIMINAL APPEAL NO(S). OF 2024
(Arising from SLP(Crl.)No(s).5890/2023 )
CENTRAL BUREAU OF INVESTIGATION APPELLANT(S)
VERSUS
AWDHESH KUMAR SINGH RESPONDENT(S)
O R D E R
Leave granted.
The respondent was detained on 23.12.2020 in connection with allegations of siphoning of money out of operations of business of chit funds. Bail was granted to him by the High Court on 01.07.2022. At this stage Mr.Banerjee, learned additional solicitor general appearing for the appellant has submitted that his clients grievances are primarily confined to the part of the order by which the High Court has directed completion of the investigation by 17.08.2022, though in the appeal grant of bail to the respondent is also assailed and that question has also been pressed before us. We, however, find no reason to interfere with the part of the order enlarging the respondent on bail.

Having regard to the dimension of scam, however, we do not think a rigid time limit ought to have been prescribed for the investigating agency to complete its investigation. Hence, we modify that part of the judgment and order impugned by which the appellant (Central Bureau of Investigation) has been directed to complete the investigation by 17.08.2022. We remove the time limit imposed on the appellant to complete investigation.

We are passing this order as there is no allegation against the respondent for not cooperating with the investigating agency. He shall continue to cooperate with the investigating agency during subsistence of the investigation. The appeal stands disposed of in the above terms.
Pending application(s), if any, shall also stand disposed of.
