O R D E R
Leave granted.
2. The learned counsel appearing for the appellant submitted that some of the accused have been granted bail, including the brother of the appellant named Sudhakaran.
The brother of the appellant who has a larger role to play, has surrendered and, thereafter, is now out of judicial custody. The appellant has been in custody for nearly 6.5 years. Though the trial is progressing, it would take considerable amount of time.
3. Ms. Aishwarya Bhati, learned ASG appearing for the respondent submitted that considering the nature of the allegation, no indulgence needs to be given, particularly when the trial is proceeding at fast pace.
4. The fact remains that the appellant has been under incarceration for more than 6.5 years and one of the co- accused who had turned approver was also granted bail.
5. The Trial would certainly take some more time to complete, which could not be completed, despite an outer
limit already granted by the High Court.
6. In such view of the matter, we are inclined to set aside the impugned order passed by the High Court and the appellant is, accordingly, directed to be released on bail on such terms and conditions as deemed fit and proper by the trial Court.
7. The appeal is, accordingly, allowed.
8. Pending applications, if any, shall stand disposed of.
