O R D E R
1. Leave granted.
2. The present appeal arises out of the impugned order dated 01.03.2023 passed by the High Court of Madhya Pradesh at Jabalpur in I.A. No.2822 of 2023 in Criminal Appeal No.430 of 2016, whereby the High Court has declined to grant bail to the appellant pending the appeal.
3. It is not disputed that the appellant has undergone actual period of 14 years of sentence, without remission. It is submitted by the learned counsel for the appellant that the appeal is not likely to be heard in the near future.
4. Having regard to the said submissions and since the appellant has already undergone substantial sentence of about 14 years, we are inclined to accept the present appeal. The appellant shall be released on bail, pending the appeal before the High Court subject to the conditions that may be imposed by the Trial Court.
5. The Criminal Appeal stands allowed accordingly.
6. Pending application(s), if any, shall stand disposed
of.
