UPON hearing the counsel the Court made the following
O R D E R
1. The captioned Special Leave Petitions are filed seeking leave to challenge the self-same order viz. , order dated 21.07.2023 passed by the High Court of Jharkhand at Ranchi in B.A. No.5707 of 2023. The petitioners filed the B.A. No.5707 of 2023 seeking bail in connection with Crime No.37/2022 registered at Police Station- Kanke under Sections 324, 307, 325, 506 and 120-B of the Indian Penal Code, 1860 and under Section 27 of the Arms Act. The said application has been dismissed under the impugned order.

2. Heard learned counsel appearing for the petitioners as also the standing counsel appearing for the respondent-State of Jharkhand.

3. The core contention of the learned counsel for the petitioners is that his co-accused, involved in other more serious offences have been granted bail. In short, the contention is founded on the
claim of parity. We have gone through counter affidavit filed on behalf of the respondent-State of Jharkhand. On such consideration, we are of the view that the petitioners are entitled
to succeed on the claim of parity as their co-accused who are charge-sheeted for the same offences and allegedly involved in other cases involving more serious offences have been granted bail, we are inclined to grant bail to the petitioners subject to the terms of the conditions to be imposed by the Trial Court. Ordered accordingly. For the purpose of complying with the order and to put conditions for the release on bail, the petitioners shall be produced before the Trial Court, forthwith.

4. The Special Leave Petitions are disposed of, as above.

5. Pending application(s), if any, shall stand disposed of.
