UPON hearing the counsel the Court made the following
O R D E R
1. This matter is list before us pursuant to the letter dated 21.11.2023 from the learned Additional Judicial Commissioner-XVI Cum Special Judge NIA, Ranchi seeking extension of time granted by this Court for conclusion of trial as per order dated 28.11.2022 passed in Special Leave Petition (Criminal) No.10939 of 2022 ( Bindeshwar Ganju @ Bindu Ganju Vs. Union of India ) for another one year. On going through the letter dated 21.11.2022 and the reasons assigned therefor, we are inclined to grant the time sought for.
2. Hence, the time stipulated stands extended by one year from today. The Registry shall communicate this order to the learned Additional Judicial Commissioner-XVI Cum Special Judge NIA, Ranchi or the Court concerned.
3. The Miscellaneous Application stands disposed of, as above.
I.A. No.265621 of 2023
1. The grievance of the petitioner is that though this Court, as per the order dated 28.11.2022 passed in Special Leave Petition (Criminal) No. 7609 of 2022 ( Bindeshwar Ganju @ Bindu Ganju Vs. Union of India through NIA ), granted liberty to the petitioner to renew his prayer for bail in case the trial of the subject case is not completed within a period of one year from 28.11.2022. The application of bail filed by the petitioner was not being take up.
2. Without making any observation with respect to the merits of the case, we make it clear that application of bail filed by the petitioner can be taken up and considered on its own merits.
3. I.A. No.265621 of 2023 stands disposed of, as above.
