UPON hearing the counsel the Court made the following
O R D E R
The petitioner seeks leave to assail the order dated 24.7.2023 passed by the High Court of Judicature for Rajasthan at Jodhpur in S.B.Criminal Miscellaneous Bail Application No. 4189/2023. The application for anticipatory bail was rejected by the High Court as per the impugned order. Heard learned counsel for the petitioner and also counsel for
the State of Rajasthan.
The subject FIR was registered against the petitioner alleging commission of offences under Sections 406, 407 and 420, of the Indian Penal Code. When this matter came up on 8.11.2023, this Court, while issuing notice, granted interim protection to the Petitioner from arrest subject to his joining and cooperating with the investigation as and when required. Learned counsel for the respondent, on instructions, submitted that subsequently, the petitioner has joined the investigation. In the said circumstances, we are inclined to make the interim protection granted to the petitioner absolute, however, subject to the petitioner continuing to co-operate with the investigation as and when he is called upon to do so. Ordered accordingly.
Necessarily, it will also be subject to the outcome of further proceedings emanating from the subject FIR. The special leave petition stands disposed of.
