Delay condoned.
Heard Mr. Girish Ananthamurti, learned counsel appearing for the petitioner.
The Counsel would read the dying declaration (Exhibit P4) of the petitioners wife and then submits that the petitioner poured water on his wife when she poured kerosene upon herself and set herself on fire. It is then pointed out that no previous complaint was filed by the deceased against her husband, alleging any creulty, etc. in the matrimonial life. The locomotor disability to the extent of 75% suffered by the petitioner is pointed out by the learned counsel to submit that the petitioner being jobless and suffering serious locomotor disability was the chief ground for dissatisfaction of the deceased and that is why she took her life and it cannot be attributed to any cruelty by the petitioner.
Leave granted.
The appellant shall remain on bail during the pendency of the appeal. Appropriate bail condition be imposed by the trial court.
