UPON hearing the counsel the Court made the following
O R D E R
Learned counsel for the respondent-State of Madhya Pradesh states that the criminal appeals of the year 2016 of the Division Bench of the High Court are now being listed for hearing.
In the present case also, the appeal pending before the High Court is of the year 2016. We further note here that the petitioner-herein, who is appellant before the High Court, has already undergone incarceration for more than 12 years. As such also, the appeal filed before the High Court should be given priority in hearing, as compared to those appeals where bail has been granted. We, accordingly, request the High Court that upon appropriate application being filed by either of the parties, the appeal may be heard as early as possible. In case the appeal is not heard within the next one year of the production of this order, it would be open for the petitioner to renew his prayer for suspension of sentence.

It goes without saying that the petitioner would extend all cooperation in the hearing of the appeal and any delay in the hearing of the appeal should not be attributable to the petitioner.
The Special Leave Petition is disposed of accordingly.
Pending application(s), if any, shall stand disposed of.
