IN THE SUPREME COURT OF INDIA
CRIMINAL APPELLATE JURISDICTION
CRIMINAL APPEAL NO. 1259 /2024
[@ SLP [CRL.] NO. 15445/2023]
BAIJIT SK. Appellant(s)
VERSUS
THE STATE OF WEST BENGAL Respondent(s)
O R D E R
Leave granted.
Admittedly the trial is yet to begin as the supplementary charge sheet has been filed only on 19.12.2023. There are 11 witnesses to the examined. The appellant has been in incarceration for more than one year and seven months.
Considering the above, we are inclined to set aside the impugned order.
Accordingly, the impugned order is set aside and the appellant is granted bail on terms and conditions to the satisfaction of the trial Court.
The appeal stands allowed accordingly.
