UPON hearing the counsel the Court made the following
O R D E R
Heard Mr. Anilendra Pandey, learned counsel appearing for the petitioner. The State of Uttar Pradesh is represented by Mr. Shaurya Sahay, learned counsel.
2. The State has filed counter affidavit where it is pointed out that the petitioner has two other criminal antecedents as mentioned in paragraph 14.
3. On the above, the learned counsel for the petitioner would submit that those are very old cases pertaining to the years 2013 and 2017 and the petitioner was granted bail in those two magistrate triable cases. It is then pointed out that the incident here occurred in the agricultural field and the petitioner is in custody for about one year six months. Moreover, although fifteen witnesses are cited for the prosecution, not a single one is
examined so far.
4. The above would show that the trial is unlikely to conclude on a near date. The other co-accused Munnu Singh has been granted bail.
5. Considering the circumstances, we deem it appropriate to grant bail to the petitioner � Bade Singh @ Badkannu in connection with the FIR No. 257 of 2022. It is ordered accordingly. Appropriate bail conditions be imposed by the learned trial court.
6. With the above, the Special Leave Petition stands disposed of.
