UPON hearing the counsel the Court made the following
O R D E R
Heard learned counsel for the petitioner.
The petitioner was convicted by the Special Court for the offence punishable under Section 7, 13(2) read with Section 13(1) (d) of the Prevention of Corruption Act, 1988 and 120-B and 201 .IPC. On appeal before the High Court, the conviction has been sustained.
It may be mentioned that for the aforesaid offences, the petitioner was sentenced to undergo imprisonment for a period of one year and payment of fine with default stipulation.
Learned counsel for the petitioner submits that during the trial as well as in the appellate proceedings, the petitioner was on bail.
Having heard the learned counsel for the petitioner and on due consideration, the prayer for exemption from surrendering is accepted.
Accordingly, the petitioner is exempted from surrendering pursuant to the judgment and order of the High Court dated 22.01.2024. I.A. No.30338/2024 is allowed.
List before the appropriate Bench having the roster after
three weeks.
