The complainant was heard by the High Court but has not been impleaded in the present proceedings and that is the grievance made by the learned counsel for the complainant. In view of the aforesaid, the complainant is impleaded as the second respondent.
Notice which is accepted by the learned counsel for the complainant.
We have heard learned counsel for the parties. The appellant has been in custody from 01.11.2021. The DNA report has not supported the allegation and the only reason which permeates the impugned order is that even if the DNA report is negative the prosecutrix cannot be disbelieved. We find this a difficult proposition to accept. In view of the aforesaid, we grant bail to the appellant on the terms and conditions to the satisfaction of the trial Court.
2The appeal stands disposed of. Needless to say that the appellant will cooperate for early completion of the trial…….J.
