UPON hearing the counsel the Court made the following
O R D E R
1 Issue notice.
2 Liberty to serve the Standing Counsel for the State of Uttar Pradesh, in addition.
3 The allegations against the petitioner, involving alleged offences under Sections 419, 420, 467, 468, 471 and 120B of the Indian Penal Code and the provisions of Prevention and Corruption Act 1988 emanate from an audit report highlighting the grant of illegal appointment.

4 By an order dated 19 May 2023 in SLP (Crl) No 6548 of 2023, further proceedings in FIR No 63 of 2023 registered at Police Station Naini, District Prayagraj have been stayed by this Court. The proceedings for the grant of bail have been continuously adjourned by the High Court.

5 The petitioner is in custody since 2 February 2023.

6 Bearing in mind the above circumstances, we direct by way of an ad interim order that the petitioner be released on bail subject to such terms and conditions as may be imposed by the Sessions Court in connection with FIR No 63 of 2023 registered at Police Station Naini, District Prayagraj, Uttar Pradesh.

7 While we have permitted the Sessions Court to fix the terms and conditions of bail, we direct that the quantum of surety shall be Rs 25,000 (Rupees twenty five thousand only).
