Heard the learned counsel appearing for the parties.
Leave granted.
The High Court passed an order dated 12th September, 2023 granting interim bail to the appellant till the final disposal of the regular bail application. By the impugned order dated
6 th November, 2023, the High Court has directed the appellant to surrender even before the regular bail application is heard. There is no material placed on record to show that the
appellant has misused the liberty granted to him under the interim order of bail.
We, therefore, modify the impugned order dated 6 th November, 2023 by directing that the interim bail granted to the appellant vide order dated 12 th September, 2023 to continue till the disposal of the application for grant of regular bail. We, however, make it clear that the High Court will decide the regular bail application on its own merits and in accordance with law.
The Appeals are partly allowed on the above terms.
