UPON hearing the counsel the Court made the following
O R D E R
Leave granted.
Heard learned counsel for the parties and perused the counter affidavit filed.

Taking into consideration the facts and circumstances of the case, especially the fact that
the case involves appreciation of evidence, particularly, when there is no eye witnesses
available, coupled with the fact that the appellant has already undergone nearly 13 years in custody, we are inclined to grant bail to the appellant on the terms and conditions to the satisfaction of the trial Court.
