Leave granted.
Heard the learned counsel appearing for the parties.
The offence alleged is under Sections 420, 406, 467, 468 and 471 of the Indian Penal Code. Prima facie, it appears to us that the dispute arises out of a property transaction. Out of total 38 witnesses, according to the respondent-State, 10 have been examined. The learned counsel appearing for the appellant states that only one witness has been examined. The appellant is in custody since 18 th October, 2022. Hence, a case is made out for enlarging the
appellant on bail.
For that purpose, the appellant shall be produced before the Trial Court within a period of one week from today. The Trial Court shall enlarge the appellant on bail on appropriate terms and conditions. The appeal is accordingly allowed.
