UPON hearing the counsel the Court made the following
O R D E R
1. The petitioner seeks enlargement on regular bail in FIR No.36/2020 under Section 302 of the Indian Penal Code, 1860 and Section 3/25 of the Arms Act, 1959. The High Court, while declining bail vide impugned order dated 06.09.2023, has observed that the Trial Court would conclude the trial by 31.12.2023.
2. We are informed that, despite the expectations expressed by the High Court, only 10 out of 42 witnesses have been examined so far.
3. Having heard learned counsel for the petitioner, we are not inclined to entertain this petition, at this stage. The Trial Court is directed to expedite the proceedings and make endeavour to conclude the trial preferably by 31.07.2024. The petitioner, if the trial is not nearing a conclusion, is granted liberty to approach the Trial Court/High Court for the grant of bail at an appropriate stage.
4. With liberty as aforesaid, the special leave petition is dismissed.
5. All pending applications, if any, stand disposed of.
