Leave granted.
Heard learned senior counsel/counsel appearing for the appellant and the State.
On going through the materials disclosed, we do not think the custodial interrogation of the appellant is necessary. We do not find any aggravating factor which would justify his pre-
trial detention.
In such circumstances, we set aside the impugned judgment and order and direct that in the event of arrest of the appellant in connection with FIR No.29/2023 registered with
Police Station Udaipur, District Ambikapur (Sarguja) in the State of Chhattisgarh, he shall be released on bail on such terms and conditions the Trial Court may consider fit and
proper.
The appellant, however, must cooperate with the investigating agency and if there is any default on that count, it shall be open to the State to apply for cancellation of the order of bail before the Trial Court itself, without any further reference to this Court.
The appeal stands allowed in the above terms.
Pending application(s), if any, shall stand disposed of.
