UPON hearing the counsel the Court made the following
O R D E R
The petitioner seeks leave to assail the order dated 17.5.2023 passed by the High Court at Calcutta in CRM (NDPS) No. 1012/2023 whereunder his application for regular bail was rejected.
The petitioner is facing trial in a case arising from FIR No. 176/2022 registered at P.S. Farakka, District Murshidabad under Sections 21(c) and 29 of the NDPS Act. Having heard learned counsel for the parties and taking into consideration the custody period undergone by the petitioner as also the nature of the offence alleged, but without expressing views on the merits of the case, the petitioner is ordered to be released on bail, subject to the terms and conditions to be imposed by the Trial Court. In that regard, the petitioner shall be produced before the Trial Court forthwith.
The special leave petition is disposed of.
