UPON hearing the counsel the Court made the following
O R D E R
Heard Mr. Siddharth R Gupta, learned counsel appearing for the petitioner.
The counsel would point out that there has been infringement of the procedure under Section 52A of the Narcotic Drugs and Psychotropic Substances Act, 1985 (for short, the NDPS Act and the High Court should have considered that factor, while considering the bail application of the accused.
We have perused the impugned order dated 23.11.2023 and considered the reasoning given by the High Court for refusing bail to the petitioner. He has been in custody since 21.03.2022 and considering the rigors of Section 37 of the NDPS Act, the High Court refused to grant bail.
We see no infirmity with the above order. The Special Leave Petition is accordingly dismissed.
