Delay condoned.

Mr. Devendra Kumar Singh , learned counsel submits that the petitioner is in custody for around 3 years and 4 months since he was arrested on 05.10.2020. That apart, the co-accused Manish Kumar was granted bail on 28.06.2023 by the High Court on the ground that the seized article is yet to be determined whether it is Psychotropic substance or not. Accordingly it is argued that parity bail should have been favourably considered for the petitioner by the High Court.

Issue notice, returnable in four weeks.

Dasti notice to the Standing Counsel for the State, in addition.
