UPON hearing the counsel the Court made the following
O R D E R
Application seeking exemption from filing certified copy of the impugned order is allowed.
Heard the learned senior counsel appearing for the petitioner. We are persuaded to grant interim relief mainly for two reasons. The first reason is that the learned senior counsel appearing for the petitioner, on instructions, makes a statement that quantity of 470 quintals of rice out of the disputed quantity is available in the godown of the society. The second reason is that in paragraph 14 of the impugned order, the High Court has recorded a finding that the petitioner had appeared before the Investigating Officer for investigation.
Issue notice, returnable on 19th February, 2024.
Liberty is granted to serve the Standing Counsel for the respondent-State, in addition.
The pre-arrest bail granted to the petitioner by the High Court shall continue to operate.
While filing a counter affidavit, the respondent/State will deal with the statement made across the Bar regarding the availability of 470 quintals of rice.
